HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Kind MD is a trade name of JAYC Inc., a Delaware corporation (JAYC Inc. d/b/a "Kind MD"). JAYC Inc. is the HIPAA-covered entity responsible for the privacy and security of your Protected Health Information.

The entity JAYC Inc, including all associated pharmacists and employees, must maintain privacy of your protected health information (PHI). The organization is required to follow current notice terms, explain legal duties and privacy practices, and notify individuals of any breaches involving unsecured PHI.

The organization reserves the right to amend this Notice. Material revisions will be posted in the pharmacy, on the website, and offered to you directly.

I. Use and Disclosure of Your PHI

A. Treatment

We may use and disclose your PHI in order to provide you with prescription and supply services. PHI may be shared with other healthcare providers involved in your care. You will receive individual notice regarding subsidized treatment communications and have the opportunity to decline.

B. Payment

The organization uses PHI to obtain payment for healthcare services and may disclose information to health plans for prior approval or coverage determinations.

C. Health Care Operations

We may use and disclose your PHI in connection with the management of our pharmacy, including quality assessment, compliance audits, and performance evaluations.

D. Prescription Refill Reminders

We may use and disclose your PHI to contact you to remind you about prescription refills, to tell you about treatment options or alternatives, or to inform you about health-related benefits.

E. Family Members

Unless you object to such disclosure, we may disclose your PHI to your family members, relatives or close personal friends. If you are unavailable, professional judgment may be exercised to determine whether disclosure serves your interests.

F. Other Permitted and Required Uses and Disclosures

PHI may be disclosed without authorization for:

• Compliance with applicable law
• Public health authorities controlling disease or reporting deaths
• Health oversight agencies conducting audits or investigations
• Judicial or administrative proceedings via subpoena or court order
• Law enforcement to report injuries or comply with warrants
• Coroners or medical examiners identifying deceased persons
• Funeral directors carrying out duties
• Organ procurement organizations facilitating donation
• Research purposes with appropriate approvals
• To avert a serious threat to health or safety
• Military and veterans activities
• National security and intelligence activities
• Presidential protection and investigations
• Correctional institutions or law enforcement custody
• Workers' compensation compliance

II. Your Rights as Our Patient

A. Right to Request Restrictions

You may request limits on PHI use/disclosure, though the organization doesn't have to agree (except for out-of-pocket transactions). Your written request must specify: (1) if you would like to restrict or limit our use and/or disclosure; (2) what information you want restricted or limited; and (3) to whom the restriction or limitation applies.

Agreed restrictions won't prevent disclosures to you, for legally permitted purposes, or in emergencies.

B. Right to Confidential Communications

You have the right to receive confidential communications concerning your PHI by alternative means or via alternative locations. Submit written requests to the Privacy Officer specifying your preferred communication method or address. Reasonable requests will be accommodated.

C. Right to Access and Copy

You have the right to access, inspect and obtain a copy of your PHI, including any electronic PHI. You may receive a copy in your requested format. You will receive a response to your request in a timely fashion but may be charged a reasonable, cost-based fee.

D. Right to Accounting of Disclosures

You have the right to receive an accounting of disclosures of your PHI made by us, including disclosures to or by our business associate(s), for a period of six (6) years prior to the date on which you request an accounting.

The first annual request is free; subsequent requests may incur reasonable fees within a twelve-month period.

E. Right to Amendment

If you believe we have PHI about you that is incorrect or incomplete, you may make a written request to us stating the reasons to support any requested amendment.

The organization may deny requests if the PHI wasn't created by them or is already accurate. You may file a statement of disagreement, and the organization may rebut it.

F. Right to Paper Copy

You have the right at any time to obtain a paper copy of this Notice, even if you receive this Notice electronically. Submit written requests to the Privacy Officer.

G. Right to Opt-Out of Fundraising

You have the right to opt-out of fundraising and your PHI will not be used for fundraising purposes or sold without your prior authorization.
