Kind MD is a trade name of JAYC Inc., a Delaware corporation (JAYC Inc. d/b/a "Kind MD"). References to "Kind MD" in this Privacy Policy refer to JAYC Inc. doing business as Kind MD.
This privacy policy describes how Kind MD and/or our owners and/or affiliates (collectively "Company," "our," "we," or "us") collect, use, disclose, and protect information about you provided through the Kind MD websites at www.kindmd.co and quiz.kindmd.co, including related public pages and flows (together, the "Site"). This Privacy Policy applies only to information collected in connection with your use of the Site. It does not apply to any other offerings, products or services. If you do not want us to collect, use or disclose information about you and your use of the Site as described in this Privacy Policy, then you should not use the Site. By using the Site, you acknowledge this Privacy Policy and our Terms of Use. That acknowledgment is separate from any optional analytics or advertising choice. Optional analytics and advertising are not required to use the Site or the quiz.
If you are a resident of California, please see our California Privacy Notice available here.
The Site gathers several types of information from and about users of the Site, including medication information, geographic location and user preferences.
The information we collect from or about you allows us to provide our services and helps us personalize and improve your experience on the Site. Depending on how you use the Site, we may collect the following categories of information directly from you:
We may also collect information directly from you outside of the Site if you provide it to us, for example, if you send Customer Service a request or email.
When you use the Site, we automatically collect some categories of information from you, such as information about your use of the Site (e.g., features used, content viewed, dates and times of interactions) and technical data about your device, such as operating system, model, device identifier, and IP address.
We may automatically collect technical information relating to you, which your web browser sends whenever you visit a website on the Internet or which is collected when you use a mobile application (see the section "Cookies and Similar Tools" below for more information). Whether optional third-party tags run depends on your cookie choice as described below.
We may offer optional measurement and advertising technologies, including Google Analytics 4 (GA4), Google Ads conversion tracking, and Meta Pixel. These tools are off by default and stay off until you select Allow. On the public website, this choice appears in a compact No thanks / Allow banner. If you select No thanks or make no choice, these third-party tags stay blocked and the Site and quiz still work. Your choice does not disrupt necessary first-party payment, order, requested-service, customer-support, security, or workflow operations.
If you permit optional analytics and advertising, the limited information sent to an enabled vendor may include neutral page IDs or page classes; quiz start, step number, step duration, abandonment step, and completion; begin checkout and purchase status, value, and currency; and ordinary device or network data a vendor may receive automatically. We configure these events to avoid collecting more than this limited scope.
Analytics and advertising tools do not receive quiz answers, clinical or medical values, full intake information, names, email addresses, phone numbers, postal addresses, payment-card details, or communications from authenticated portals, providers, or support channels. We do not intentionally send this information to these tools. Cookie consent is not authorization to disclose protected health information and does not replace separate controls or notices for care, clinical, or operational processing.
The quiz does not automatically show a floating cookie banner. Its first screen explains that responses help personalize the quiz and are not used for a medical assessment before account creation. Selecting Continue does not turn on optional analytics or advertising.
The same screen offers a separate No thanks / Allow choice for optional cookies. You may continue the quiz whether you allow, decline, or make no optional choice. When permitted, analytics and advertising tools receive only the limited, sanitized events described above, not your quiz answers or medical information.
We use information to support telehealth consent, provider review, order processing, payment, fulfillment, customer support, care coordination, safety notices, compliance, and Site operations.
Information we collect about you may be used for the following purposes:
When permitted by applicable law, we may also:
Your information may be disclosed to the following third parties:
Note: All other use case categories exclude text messaging origination opt-in data and consent; this information will not be shared with any third parties.
We and our service providers may share reports on user demographics and traffic patterns that do not identify you, as well as other information that does not identify you with third parties.
When you use our quiz, intake, checkout, telehealth, messaging, or other patient-related services, you may provide health information, medication-related information, contact information, and communication preferences. Additional terms and notices may apply to those services:
These linked notices are part of the privacy and consent framework for Kind MD services. They should be reviewed together with this Privacy Policy and our Terms of Use.
Operational processing: We use service providers for necessary first-party payment, order, requested-service, customer-support, security, customer-relationship-management, and workflow operations. Depending on the service, these providers may process information needed to take payment, fulfill an order, provide requested services, communicate with you, or operate the Site under their applicable agreements and notices. Campaign attribution and click IDs may be stored with first-party operational or customer-relationship-management records, but the prepared analytics adapter does not send them as custom event parameters to GA4, Google Ads, or Meta. This processing is separate from optional analytics and advertising tags.
We take reasonable steps to protect your personal information, which is any information that identifies you or could reasonably be linked to you. We also use encryption technology, called Secure Sockets Layer (SSL), to help protect personal information in certain areas of our Site during transport across the Internet. The presence of SSL encryption may be indicated by https in the browser URL or the image of a closed lock or solid key in the browser window. These indications may not be present in mobile services that use SSL.
Unfortunately, there is always some risk that an unauthorized third party may find a way around our security measures. We cannot guarantee that the Internet or any other technical system will be 100% secure or error-free. We are not responsible for the security of information you transmit over networks that we do not control, including the Internet and wireless networks. Please note that e-mails and other communications you send to us are not encrypted, and by communicating with us by email you accept the risk that any personal information contained in the email may be intercepted or accessed by unauthorized parties.
You may opt out of receiving marketing emails by using the unsubscribe information available in any marketing email, or by emailing us at care@kindmd.co. To the extent that you use the Site, there are certain messages you may not opt out of receiving, such as non-promotional email messages about programs or services you have registered for or certain administrative, technical, or safety notices about the Site or our products or services.
You may reopen the Site's Cookie choices control at any time to review or change your permission for optional analytics and advertising. If you withdraw that permission, optional analytics and advertising tags stop firing for future activity; this does not by itself erase records already processed. Contact care@kindmd.co with questions or requests about prior data.
Ordinary "Do Not Track" (DNT) is a browser preference, and the Site does not treat a DNT signal as a consent choice. Global Privacy Control (GPC) is a separate browser or device signal recognized under some state laws. The current Cookie choices control does not read GPC automatically. You may use Cookie choices or contact us to decline or withdraw optional tags. Before optional advertising tags are published, we will implement any GPC or other universal opt-out handling required by applicable law and update this policy to describe the verified process.
Depending on your state or other jurisdiction, you may have rights to request access to, correction of, or deletion of personal information; opt out of sale, sharing, targeted advertising, or certain profiling; or limit certain uses of sensitive personal information, subject to applicable exceptions. To submit a request, contact care@kindmd.co or +1 279-203-0551 and identify your state and request type; we may verify your identity as allowed by law. If we deny a request and applicable law provides an appeal, you may appeal by replying to our decision or emailing care@kindmd.co with "Privacy Appeal." We will handle requests and appeals under the time limits and procedures required by applicable law.
The Site is intended for adults only and are not directed to, nor do we knowingly collect information from, individuals under the age of 18. If you become aware that your child or any individual under your care who is under the age of 18 has provided us with information without your consent, please contact us at the contact information listed below.
Pursuant to California Civil Code Section 1798.83, if you are a California resident, you have the right to request information about how and to whom we disclose certain categories of your personal information for their direct marketing purposes, once per calendar year. You can make this request to us via email at: care@kindmd.co or by calling toll-free at +1 279-203-0551.
If you are a resident of California, please see our California Privacy Notice for additional provisions that apply to you.
Our Site may include links to external third-party websites and online services that are not under our control. We are not responsible for the collection, use, and disclosure of your information on those websites and other online services provided by those third parties. We encourage you to review the privacy policies and terms of use of each website and other online service you visit. The inclusion of links to external third-party websites and online services does not imply endorsement of, or association with, such websites and online services by us, or any warranty of any kind, either express or implied.
We use essential cookies and similar technologies to support Site functions, security, preferences, and first-party operations. Optional analytics and advertising technologies are consent-gated as described above. If you permit them, enabled vendors may place or read cookies or use similar technologies for the limited events and data described above. If you decline or withdraw permission, we block those optional vendor tags while essential first-party payment, order, care, customer-support, and security operations continue. Browser settings may also block cookies, but doing so can affect Site functions. Cookie choices do not authorize disclosure of quiz, intake, clinical, medical, or other protected health information to analytics or advertising vendors.
We will retain your personal information in accordance with our record retention policies and as permitted by applicable law unless you instruct us to remove it by contacting us at care@kindmd.co. We will also retain your personal information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. You can update the personal information you have provided to us at any time by writing to the program administrator at JAYC Inc. Attn: Privacy Team/Regulatory Compliance, 1111B South Governors Ave STE 87990 Dover, DE 19904
We retain consent choices, cookie settings, configuration records, and any approved analytics or advertising records only as configured in the applicable system and as reasonably necessary for the purposes described here, security, legal obligations, disputes, and rights requests. We may retain records longer when required by law or needed to establish, exercise, or defend legal claims. Withdrawing consent stops future optional tags but does not automatically erase earlier records. You may submit a request using the contact information below, subject to applicable law.
